Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes how you may, and may not, use the MoldMind Service. It is part of, and supplements, the MoldMind Terms of Service. A violation of this AUP is a material breach of the Terms.

1. Who This Applies To

This AUP applies to every person who accesses or uses the Service, including organization administrators, Inspectors, billing contacts, and any third party you authorize to access your Account. You are responsible for ensuring everyone acting under your Account complies with this AUP.

2. Content Restrictions

You will not upload, generate, store, or transmit through the Service any content that:

  • Is unlawful, defamatory, fraudulent, deceptive, obscene, harassing, threatening, abusive, or that promotes violence, self-harm, or discrimination on the basis of a protected characteristic;
  • Infringes or misappropriates any patent, copyright, trademark, trade secret, or other intellectual property right;
  • Violates any person's privacy, publicity, or personality rights, or any non-disclosure obligation you owe to a third party;
  • Contains personal data of any person who has not consented (where consent is the legal basis you are relying on) or for which you do not have another lawful basis to process and to instruct MoldMind to process;
  • Is malicious code, including viruses, worms, ransomware, spyware, keystroke loggers, or any other software designed to interfere with, damage, exfiltrate from, or surveil any system or person;
  • Is regulated content that requires a license, permit, or accreditation MoldMind does not hold and that the Service is not designed to handle (for example, certain healthcare data covered by HIPAA, or controlled unclassified information, unless we have expressly agreed in writing).

3. Prohibited Conduct

You will not, and will not permit any third party to:

  • Use the Service in any manner that violates applicable law, regulation, or professional licensing rule (including state inspector-licensing requirements, the IICRC Code of Ethics, AIHA Code of Ethics, and similar professional standards);
  • Misrepresent your identity or affiliation, or impersonate any person or organization;
  • Access or attempt to access another customer's Account, Customer Content, or organization data without authorization;
  • Probe, scan, or test the vulnerability of the Service, or breach or attempt to breach any security or authentication measure, except under a written authorization from us;
  • Interfere with or disrupt the Service, the servers and networks that host it, or any other user's use of the Service, including by introducing malware, mounting a denial-of-service or other availability attack, or generating excessive load;
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code, model weights, prompts, system instructions, schemas, or other proprietary components of the Service, except to the extent that this restriction is prohibited by applicable law;
  • Modify or create derivative works of the Service or any part of it that we have not made available for that purpose;
  • Resell, sublicense, lease, lend, distribute, white-label, or otherwise commercially exploit the Service except as expressly permitted by us in writing;
  • Use the Service to build, train, fine-tune, or improve any competing product, service, or AI model;
  • Scrape, harvest, or use automated means to extract data from the Service other than via APIs we expressly provide and within the rate limits we publish;
  • Circumvent any usage limit, rate limit, billing cap, access control, or other technical measure;
  • Remove, obscure, or modify any proprietary notice, attribution, or branding within the Service;
  • Use the Service for any high-risk activity where failure could lead to death, serious bodily injury, or severe environmental damage without independent human verification (the Service is an AI-assisted drafting tool, not a safety-critical decision system).

4. AI-Specific Prohibitions

You will not:

  • Submit input that is designed to manipulate, jailbreak, or otherwise subvert the Service's AI models, including content designed to extract proprietary system prompts, training data, or model weights;
  • Submit input that is designed to suppress or distort AI output, including prompt-injection payloads, embedded instructions targeted at the model, or content crafted to cause the model to ignore safety, accuracy, or formatting requirements;
  • Use the Service's AI features to generate content for use outside the inspection workflow (for example, to generate unrelated essays, code, or chat responses); the Service's AI is licensed only for the inspection report use case;
  • Use AI output as a substitute for the professional judgment, training, and on-site observation required by your professional license; you remain accountable for every conclusion and recommendation reflected in a finalized Report.

5. Fair Use and Plan Limits

Subscriptions include per-plan usage limits (number of jobs, reports, photos, voice memos, document uploads, or AI generations per period). The limits are designed to support an active solo or small-team inspection business.

Usage that materially exceeds the cap of a normal active inspection practice — for example, a single-Inspector Account generating thousands of unrelated Reports per week, or sustained traffic patterns consistent with automated scraping rather than human use — may be rate-limited, throttled, or suspended at our discretion at any time and without prior notice. For non-emergency cases involving apparent good-faith usage that fits a normal inspection workflow, we will typically provide notice before implementing rate limits that would materially disrupt your business operations.

Specific numeric limits and pricing are published on our pricing page and may change as we tune the Service.

6. Security and Vulnerability Reporting

If you discover a security vulnerability in the Service, please report it to security@moldmindai.com with a description of the issue, steps to reproduce, and any supporting evidence. We will acknowledge reports within a reasonable period and prioritize remediation according to severity. We do not currently operate a paid bug-bounty program but we appreciate good-faith disclosure and will reasonably engage with researchers acting in good faith.

You may not publicly disclose a vulnerability until we have had a reasonable opportunity to investigate and remediate it.

7. Compliance With Standards and Licensing

You agree that any Report generated through the Service is your professional work product and that you are solely responsible for compliance with:

  • Applicable inspection standards (including IICRC, AIHA, ACGIH, ASHRAE, ASTM standards referenced in the Service);
  • State and local inspector-licensing requirements;
  • Professional codes of ethics applicable to your discipline; and
  • Any client or contractual obligations you have separately undertaken.

8. Enforcement

We may investigate any suspected violation of this AUP. In doing so, we may review Account activity logs, Service usage patterns, and Customer Content to the extent reasonably necessary to investigate, in each case consistent with the Privacy Policy and applicable law.

Where a violation is unintentional and curable, we will provide reasonable opportunity to cure before suspension or termination. Where the violation is serious — including, without limitation, a violation that creates a security, fraud, regulatory, or legal risk; a violation involving infringement or misuse of intellectual property; or a repeat violation following prior notice — we may suspend or terminate immediately and without prior notice.

Suspension does not relieve you of paid Subscription obligations for the suspended period unless we mutually agree otherwise in writing.

9. Reporting AUP Violations

If you believe another user has violated this AUP, contact abuse@moldmindai.com with a description of the conduct and any supporting evidence. We will investigate and act as appropriate, including (where the report involves potentially illegal conduct or imminent harm) by contacting law enforcement.

10. Changes to This Policy

We may update this AUP from time to time. For minor or clarifying changes, we will post the revised AUP with a new "Last updated" date. For material changes (such as the addition of new categories of prohibited conduct), we will provide notice consistent with the Terms of Service.
